Terms and Conditions

  1. INTRODUCTION

    1. The Website (as defined below) is owned and operated by Nationwide Accreditation Bureau Limited ("NAB", "we" or "us") having its registered office at 61 Southwark Street, London Bridge, London, SE1 0HL and registered number 03978803 (England and Wales).
    2. These Terms (as defined below) set out the contract terms between you (being the Registered User)s ("You") and us, governing the access and use of the website and the Products (as defined below). By ticking the "I accept" box you accept these Terms.
    3. Access to and use of the Website and the Products is provided by NAB subject to the Terms. NAB may change these Terms at any time by posting changes on the Website. Please review these Terms regularly to ensure you are aware of any changes made by NAB. Your continued use of the Website and the Products after changes are posted means you agree to be legally bound by these Terms as updated and/or amended.
  2. DEFINITIONS

    In these Terms:

    1. "Products" means the computer based training programs accessible on the Website;
    2. "Registered User" means any person who has paid for one or more of the Products and has been allotted a user name and password;
    3. "Terms" shall mean these terms and conditions; and
    4. "Website" means www.thenab.co.uk/training.html
  3. OWNERSHIP OF RIGHTS

    1. All intellectual property rights, including copyright, in the Website are owned by or licensed to NAB. Any use of the Website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited, unless it is with the prior permission of NAB. Nothing contained in these Terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any intellectual property right owned by NAB or its licensors. MWF, NAB, Global People and Global People logo are trade marks of NAB and may not be used by you, other than with our prior consent.
    2. You may not modify or distribute anything on the Website (including the Products) for any purpose. You also agree not to adapt, alter or create a derivative work from content on the Website (including the Products) except for your own personal, non-commercial use. Any other use of the Website content requires the prior written permission of NAB.
    3. You agree to use the Website only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Website.
  4. RIGHT OF ACCESS

    1. Right of on-line access to one or more of the Products becomes available to you after you make payment for the Products and become a Registered User. There will be no contract of any kind between you and us unless and until you become a Registered User.
    2. Please note that you are responsible for accessing the Products using an appropriate Internet connection and a browser.
    3. Where payment for a Product is required to be made on a periodic basis, a failure to make such periodic payment may result in a withdrawal of on-line access to such Product
  5. PASSWORD/ACCOUNT SECURITY

    1. You are responsible for maintaining the confidentiality of your username and password. You are also responsible for any activities that occur under your username. NAB shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.
  6. CANCELLATION

    1. Under the distance selling regulations you have the legal right to cancel your order within seven working days of becoming a Registered User. In order to exercise this right, please contact us on support@thenab.co.uk within seven working days of becoming a Registered User. Once you have accessed and used one of our Products, your right to cancel shall cease.
  7. OUR LIABILITY TO YOU

    1. You must assume the entire risk of using the Products. Our liability will be limited exclusively to the cost of replacing the Product or a refund of the purchase price.
    2. We shall not be liable to you or any business connected to you, either in contract, tort (including negligence) or otherwise for any losses which are related to you or your business, including, without limitation, loss of data, loss of profits, loss of revenue or business interruption or any losses which are not reasonably foreseeable by us.
    3. We shall not be liable for non-performance or delays hereunder due to causes beyond our reasonable control. These causes shall include without limitation acts of God, war, riots, strikes, fires, storms, flood, earthquake, acts of any government or agency thereof, judicial action or any or all other causes beyond our reasonable control. In the event of any such excused delay failure of performance the date of delivery shall at our request, be deferred for a period equal to the time lost for reason of the delay. We shall notify you of any such event of circumstances within a reasonable period after we are aware of same.
    4. NAB has taken every care in the preparation of the content of the Website, in particular to ensure that all products have been fairly described. All prices are displayed exclusive of VAT. To the extent permitted by applicable law, NAB disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on the Website. NAB shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on the Website.
    5. NAB makes every effort to ensure that the Website is free from viruses or defects. However, we cannot guarantee that your use of the Website or any websites accessible through it will not cause damage to your computer. It is your responsibility to maintain up to date virus protection. NAB shall not be liable to your or any person for any loss or damage which may arise to computer equipment as a result of using the Website.
    6. From time to time, we may place links on the Website to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents. NAB cannot accept any liability in respect of the use of these websites.

  8. USE OF THE WEBSITE FROM OUTSIDE THE UK

    1. Unless otherwise specified, the materials on the Website and the Products are directed solely at those who access the Website from the United Kingdom.
    2. NAB make no representation that the Products or Services are appropriate for use, or available, in other locations. Those who chose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable.
  9. REPRESENTATIONS AND WARRANTIES

    1. None of our employees or agents is authorised to make any statement, warranty or representation as to the Products. You may not therefore, be entitled to rely or to seek to rely upon any statement warranty or representation made by an employee or agent of the Seller.
    2. The Website's content, including the information, names, images, pictures, logos and icons regarding or relating to NAB, its Products and Services, is provided "as is" and on an "as available" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent required by law. Because of the various hardware and software environments in which the Products may be used, no warranty of fitness for a particular purpose is offered, including implied warranties, terms or conditions of satisfactory quality, non-infringement, compatibility, security and accuracy.
  10. GENERAL

    1. The Website, Products, any content contained on the Website and any contract brought into being as a result of usage of the Website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales.
    2. If any of these Terms are determined to be illegal, invalid or otherwise unenforceable, then to the extent and within the jurisdiction in which that Term is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms and the remaining Terms shall survive, remain in full force and effect and continue to be binding and enforceable.
    3. Any notice, request, instruction or other document to be given hereunder shall be delivered or sent by first class post to the address of the party set out in these Terms (or such other address as may have been notified) and any such notice or other document shall be deemed to have been served at the time of delivery or upon the expiration of 48 hours after posting (whichever is the earlier).
    4. We will guard the personal information you share with us and at no time offer any user-provided information to third parties. Our representatives may use the information you have provided us to alert Register Users to course upgrades, special offers, updated information, new services, and other NAB or Software-related information.
    5. This contract and any rights hereunder may not be assigned or transferred by you without our consent and any attempt to do so without such consent shall be void. Therefore, you may not transfer your username or password to any other person (other then an employee of your organisation) for consideration or otherwise, without our prior consent.
    6. We reserve the right to assign our rights and obligations to you to any other person.
  11. TERMINATION

    1. Without prejudice to any other rights, NAB may terminate this agreement by notice if you fail to comply with these Terms.
